Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. I have a peculiar issue. I was working with a company from 2000 to 2004 on H1B and then went back to India for good. During that period I applied for Labor.
I joined the same company again and came back to US in Feb 2007 on new H1.
Now I am applying for I-485 for myself, my wife and daughter. My lawyer is saying that I have to fill I-134 (affidavit of support) also. But my salary is around 55K and I don't have much balance in bank. Its around 2-3 K only.
My question is, can I show assets/money from my Indian bank. I have talked to a CA in INdia and he will prepare a statement for me.
I am not sure if I can use that in I-134 or not. Can anybody has done that ?
Any help/suggestion would be appreciated..

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.
My questions are:
1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.
2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.
3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.

Visa Number is just created for ASIAN people not any one else. Visa Numbers are allocated before M.L.King and not revised since then and never revised.

I am working for Company A on a full time basis on H1B and part-time with Company B(non-profit) on a concurrent H1B. I filed for my GC with Company A and I-140 is approved and applied for I-485 and got EAD/AP also.
My H1B with Company B is expiring and the 6 year term will end on December 31, 2009. I am planning to apply for H1B extension for this H1B and the company attorney says I can get it extended based on Company A I-140 because it is a concurrent H1B. How far is this true? Can I extend my Company B H1B based on the approval on Company A H1B?

If the form specifically asks for wage/week then I believe the correct response should be in that unit. I think your lawyer is wrong here to put your annual income there. But what do I know.....I am not an attorney.
This item deals with "Wage per week " in this field after i checked out my application lawyer gave the whole years income instead of weeks income. as i enquired he said even though "/year" is ideal to mention immigration officers know that this amount is same as that of Labor and thats not an issue . any comments please?

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.

Since you applied for extension before your current H1 expired, you are allowed to continue to work for 240 days from the date of H1 expiry. If your H1 is still not approved, then I believe you will have to stop working but can still be in the country till a decision has been made on your petition. Your employer could try and upgrade your pending application to premium processing so you will get to hear from USCIS within 15 days.
